License agreement
By opening, copying, or installing any Data or Software supplied by Oricsoft (the company behind Kibot), you become a Licensee and agree to be bound by the terms below. Any reference to “he” shall be taken as a reference to “he” or “she”.
Definitions
- Data means trading information for securities, and related or derived information.
- Software means the Oricsoft Kibot Updater, Kibot API Client, Kibot Agent, and Kibot API software.
- Documentation means the written materials you may receive in connection with the Data or Software.
- You or your means the person or company being licensed to use the Data and Software. We, us, and our means Oricsoft.
License grant
We hereby grant you a non-exclusive, non-transferable, revocable license to use the Data, Software, and Documentation on the following terms:
- The Licensee warrants that he will not resell or redistribute the Data or the Software.
- The Data is for the private use of the Licensee only.
- The Licensee may use the Data and Software on two computers that are normally accessed by the Licensee for personal use.
- The Licensee may copy the Data and Software for archival purposes, provided that any copy contains all of the original Data and Software's proprietary notices.
No separation or transfer of license
The Data and Software are licensed as a single product. The Licensee agrees that the material comprising the Data and Software will not be transferred to any other party.
Rent or lease
The Licensee agrees not to rent or lease Data and Software provided by Oricsoft.
Subscription information
The Licensee is responsible for protecting the confidentiality of his account information and will not make his user details available to another party. Data subscriptions are renewed on a monthly basis and can be cancelled or suspended by the Licensee at any time through FastSpring. Refunds will not be provided in the event that the Licensee determines that a Data service is no longer required. See the subscription tiers for plan details.
Accuracy of information
All material is provided in good faith and is derived from sources believed to be accurate. Oricsoft and its associates do not make any representation or warranty as to the timeliness, reliability, accuracy, or completeness of the Data, nor do they accept any responsibility arising in any way from errors in it or omissions from it. Nothing in these conditions shall exclude, restrict, or modify any condition or warranty implied by law. Oricsoft and its associates may provide corrections to the Data without notice, see data completeness for the ongoing QA process.
No liability for consequential damages
The Licensee agrees that Oricsoft and its associates will in no event be liable for any damages, including lost profits, lost savings, or other incidental or consequential damages arising out of or relating to delays, omissions in collection and dissemination of the Data, or for the inaccuracy of information.
To the maximum extent permitted by applicable law, in no event shall Oricsoft and its associates be liable for any special, incidental, indirect, or consequential damages whatsoever, including, without limitation, damages for loss of business profits, business interruption, computer failure or malfunction, loss of business information, or any other pecuniary loss, arising out of the use of or inability to use the Data or Software, even if Oricsoft and its associates have been advised of the possibility of such damages.
Modifications, derivative works, and reverse engineering
The Licensee agrees not to copy, modify, translate, reverse engineer, decompile, disassemble, or create derivative works, nor allow any other party to do any of the foregoing, based upon the Software or Documentation.
Notices
The Licensee agrees not to remove any proprietary notices or labels on the Software or Documentation.
Termination
This License Agreement shall terminate automatically if the Licensee fails to comply with the limitations described in this license. On termination, the Licensee must destroy all copies of the Software, Documentation, and Data.
